<title>W+K Shanghai Promotes Planner Nick Barham to co-ECD</title>

<p>In a move that is sure to make planners smile and creatives wince, Wieden + Kennedy Shangai have elevated <strong><a href="http://www.mediabistro.com/Nick-Barham-profile.html">Nick Barham</a></strong> from a planning role to co-ECD at W+K Shanghai. In the position, he will work directly alongside co-ECD <strong><a href="http://www.mediabistro.com/Nick-Cohen-profile.html">Nick Cohen</a></strong> and the agency branch&#8217;s MD <strong><a href="http://www.mediabistro.com/Kel-Hook-profile.html">Kel Hook</a></strong>.</p>
<p>Barham, whose client portfolio includes Nike, Converse, Coca-Cola and Nokia, moved to the Chinese metropolis four years ago to take a post at TBWA. The move comes during what may be a time of relative planning dominance, depending on which side of the aisle you&#8217;re sitting on. Many creatives have used this Web site to air their qualms regarding the increased cross-over of planning/creative roles. Planners on the other hand tend to see their roles as overseeing strategy, which includes creative.</p>
<p>PSFK for one has begun studying planning with a program called &#8220;<a href="www.psfk.com/spur">SPUR</a>&#8221; (note: PSFK has been down for server repair since this morning, so that link probably won&#8217;t work We&#8217;ve <a href="http://www.mediabistro.com/agencyspy/planningconsumer_insights/spur_a_psfkredscout_initiative_for_planners_141654.asp">written about the project here</a>), a video interview series aiming to further develop the concept. This relatively new entrant to the field is seen by many as a waste of client money, where conversely planners say the same of some creatives. Putting Barham in such a position is proof (in part) that the fields are converging ever-rapidly.</p>

<title>FTC Endorsement Regs Take Effect Tomorrow, So Far Little Change Seen</title>

<p>In the time that since the Federal Trade Commission released new guidelines regarding celebrity endorsement and disclosure, there&#8217;s been much discussion about the implications of <a href="http://www.mediabistro.com/prnewser/social_networks/ftc_clarifies_blogger_guidelines_weve_never_brought_a_case_against_somebody_simply_for_failure_to_disclose_139589.asp">making the practice more responsible</a>. As of tomorrow, the talk will be backed up by some form of action, though the FTC seems to find their <a href="http://www.mediabistro.com/agencyspy/social_media/serena_williams_nabisco_tweet_ok_with_ftc_despite_lack_of_disclosure_144100.asp">new found chores brackish</a>.</p>
<p>As we discovered, some social media programs may be unabated by the rules. From tennis star <strong><a href="http://www.mediabistro.com/Serena-Williams-profile.html">Serena Williams</a></strong>&#8216; <a href="http://www.mediabistro.com/agencyspy/social_media/serena_williams_nabisco_tweet_ok_with_ftc_despite_lack_of_disclosure_144100.asp">neglectful tweet</a> to <strong><a href="http://www.mediabistro.com/Melanie-Notkin-profile.html">Melanie Notkin</a></strong>, a blogger better known as Savvy Auntie who published a number of undisclosed tweets (<em>see update below</em>) about JCPenney over the weekend. The clothier pays Notkin for placements <a href="http://twitter.com/SavvyAuntie/statuses/6205448097">like this</a>.</p>
<p>But so far the rules have been unclear. As Notkin herself <a href="http://twitter.com/SavvyAuntie/statuses/6203008481">points out</a> in a tweet referring back to the <a href="http://www.mediabistro.com/prnewser/social_networks/did_the_ftc_just_open_up_even_more_of_a_slippery_slope_on_disclosure_144232.asp">Serena Williams story</a>.</p>
<p>The FTC has made it clear that they&#8217;ve yet to reprimand a celebrity or other notable figure for failing to disclose, saying that they&#8217;d focus on the sponsor instead. In regards to Williams, they said &#8220;Although we do not generally comment publicly about ongoing advertising campaigns, it seems pretty clear that Serena Williams&#8217; tweet about Nabisco Calorie Pack is sponsored advertising. (She says that she is shooting a campaign for Nabisco),&#8221; said <strong><a href="http://www.mediabistro.com/Richard-Cleland-profile.html">Richard Cleland</a></strong>, Assistant Director, of the FTC&#8217;s Division of Advertising Practices. &#8220;When it is clear from the context of a communication that the celebrity is being paid, an additional disclosure is not required.&#8221;</p>
<p>It&#8217;s but one example of how complicated the problem may become. In Williams&#8217; case, she initially tweeted that she and sister Venus were sponsored by Nabisco. But in a subsequent tweet, there was no disclosure. The FTC did not provide clarification.</p>

<p><b>Update:</b> Notkin commented that we were unfair to state that she &#8220;published a number of undisclosed tweets about JCPenney over the weekend&#8221; &amp;#151 calling that phrase untrue. Here&#8217;s a list of Tweets referring to her sponsor that weren&#8217;t disclosed. (<a href="http://twitter.com/SavvyAuntie/status/6145632399">1</a>: in a previous tweet she told people they could buy this product at JCP, <a href="http://twitter.com/SavvyAuntie/status/6143614751">2</a>: an article discussing JCP&#8217;s sale notices on Twitter; <a href="http://twitter.com/SavvyAuntie/status/6201150492">3:</a> she discusses a video she hosted for JCP).</p>
<p>We&#8217;re not here to say she was wrong. Read her comment below. The point is that this is not, as Notkin mentions, a perfect science. It&#8217;s a can of worms the FTC may not have been prepared to open. Was Notkin wrong to say &#8220;The Kodak Zi8 is pretty amazing&#8221; without disclosing even though she did in a previous Tweet? It depends on who is reading it: if a person follows her every Tweet, no harm done. But there&#8217;s no guarantee of that, which is where the problems begin. Other than a few minor slip-ups (if you can call them that) Notkin&#8217;s efforts have been, as she put it, 95% transparent.</p>

Although the brand <a href="http://momento24.com/en/2009/11/26/gillette-modifies-an-advert-after-henrys-controversial-hand-move/">denies a connection</a> to the athlete&#8217;s recent <a href="http://www.guardian.co.uk/football/2009/nov/23/thierry-henry-ireland-handball-francehttp://www.guardian.co.uk/football/2009/nov/23/thierry-henry-ireland-handball-france">taking to handball</a>, it&#8217;s hard to ignore the message. <title>Could Tiger&#8217;s Ride Through the Woods Hurt Sponsorships?</title>
<description><![CDATA[<p>It&#8217;s doubtful that <strong><a href="http://www.mediabistro.com/Tiger-Woods-profile.html">Tiger Woods</a></strong>&#8216; weekend <a href="http://www.mediabistro.com/agencyspy/the_menu/today_on_the_menu_tigers_pr_claws_itself_jim_lehrer_steps_aside_dvrs_are_killing_leno_nook_selling_on_ebay_144370.asp">debacle</a> will hurt his reputation with sponsors.</p>
<p>But that didn&#8217;t stop <strong><a href="http://www.mediabistro.com/Ken-Sunshine-profile.html">Ken Sunshine</a></strong>, principal at Sunshine Sachs PR, from alleging that it might, on <em>The Early Show</em>. Or it might help him, because whatever may have happened could possibly humanize the golfer.</p>
<p>We&#8217;re petitioning for a &#8220;nothing-at-all-could-happen&#8221; option, because there&#8217;s something fun about being right in the middle of the spectrum. But this is America, where the only people we listen to are on one side or another, so.</p>

<p>Sure, it&#8217;s a month or so old, but since the exhibit&#8217;s ongoing through February, this clip for the Denver Museum of Nature and Science is still timely. Carmichael Lynch and VFX/design house Impossible designed this 30-second spot for the <a href="http://ww2.dmns.org/teachers/at-the-museum/temporary-exhibitions/genghis-khan">Genghis Khan exhibit</a>, which features a <em>300</em>-styled arrow assault that portends the Mongol ruler and his army&#8217;s invasion of the Mile High City.</p>
