| Duane | Posted 3/20/2008 9:06:34 PM | show profile | email poster Sorry if I'm in the wrong place. I'm new to the forum and am faced with a problem I didn't anticpate having. I recently got an email through my Flickr account asking for the rights to use one of my posted photos. The person represents himself as being with a production company which is developing a show for a major cable network, and they want to use my photo in some way or other. I said sure, shoot me some paperwork. Having been an LA messenger some years back, I do know that the address he uses is in the right part of Hollywood (Sunset, between Vine and Cahuenga, in building housing other media types). What he sent me was a photo release form. Quite obviously the expectation is that I would simply sign the release and return it to him, and be glad that I was finally getting my chance to get into showbiz. Anyway, does anyone have an idea what the going rate would be for something like this? And how would I go about getting paid. Is there a standard contract form or something which I could use? Again, I know this is off topic for this forum, but I really am clueless about this sort of thing :) I've got no particular aspiration to become a freelance photographer myself, this is just sort of a windfall that fell in my lap. I wouldn't want to help dilute the market for the working pros, however. Thanks again. Duane |

Thank you! A great place to look for contracts is the ASMP website - asmp.org. You can get alot of general contract info there without being a member. You need specifics from the production company as to exactly how the photo will be used, how long, etc. If the photo is used as part of the show, do you get residuals? It's been my experience with Flckr queries (mostly, tho not always) that companies are just looking for a freebie and think that the ego gratification to the photographer will suffice for 'payment.' This seems like a professional company (at least they presented themselves that way) so you need to deal with them in a professional manner as they should also deal with you professionally.
