<title>DOJ Sends Another Letter to AP, AP Remains Unhappy</title>
<description><![CDATA[<p><img class="alignright size-full wp-image-82693" title="" src="http://www.mediabistro.com/fishbowlny/files/2013/05/Screen-Shot-2013-05-13-at-5.34.24-PM1.png" alt="" width="115" height="135" />The Department of Justice is trying to brush off the <a href="http://www.mediabistro.com/fishbowlny/justice-department-secretly-obtains-ap-phone-records_b82572">secret accessing of Associated Press editors and reporters phone records</a>. The agency already sent one bland letter to the AP about the incident, and today, it sent another. According to AP CEO and president <strong><a href="http://www.mediabistro.com/Gary-Pruitt-profile.html">Gary Pruitt</a></strong>, both letters from the DOJ basically said &#8220;Meh,&#8221; and not much else about the scary over-extension of the government.</p>
<p>&#8220;We appreciate the DOJ’s prompt response, but it does not adequately address our concerns,&#8221; writes Pruitt, <a href="http://blog.ap.org/2013/05/13/ap-responds-to-intrusive-doj-seizure-of-journalists-phone-records/" target="_blank">in a statement</a>. &#8220;The letter simply restates the law and claims that officials have complied with it.&#8221;</p>
<p>Pruitt goes on to say that he believes the root of the DOJ&#8217;s shady move was an AP report about the government stopping a bomb from being placed on a plane in May of last year. Though the AP worked with the government to ensure it didn&#8217;t reveal any national security information, Pruitt suggests that ultimately, the AP&#8217;s report didn&#8217;t paint the feds in a kind enough light.</p>

<title>Justice Department Secretly Obtains AP Phone Records</title>
<description><![CDATA[<p><img class="alignright size-full wp-image-82575" title="" src="http://www.mediabistro.com/fishbowlny/files/2013/05/Screen-Shot-2013-05-13-at-5.34.24-PM.png" alt="" width="115" height="135" />This is sort of insane: The United States Justice Department has secretly obtained two months worth of phone records from Associated Press reporters and editors. The records contained incoming and outgoing calls and the duration of calls made via 20 different lines assigned to AP offices, and journalists&#8217; home and cell phones. That&#8217;s a scarily large swath.</p>
<p>In a letter to the AP, the DOJ apparently offered no explanation for the seizure. The AP&#8217;s CEO and president, <strong><a href="http://www.mediabistro.com/Gary-Pruitt-profile.html">Gary Pruitt</a></strong>, responded with his own letter, protesting the DOJ&#8217;s actions:</p>

<p>The complete abandonment of facts and subsequent bear hugging of rumors forced the FBI to <a href="http://www.fbi.gov/boston/press-releases/2013/no-arrest-made-in-bombing-investigation" target="_blank">issue a statement</a>. The short version: Shut up nothing has happened. Idiots.</p>

<title>NY Times Prints Op-Ed By Gitmo Prisoner</title>

<p>The inmate at the military&#8217;s most infamous prison described the daily despair and degradation he and other hunger strikers suffer in an op-ed titled, &#8220;<a href="http://www.nytimes.com/2013/04/15/opinion/hunger-striking-at-guantanamo-bay.html?_r=0" target="_blank">Gitmo Is Killing Me.</a>&#8221;</p>
<p>&#8220;I’ve been on a hunger strike since Feb. 10 and have lost well over 30 pounds,&#8221; he wrote. &#8220;I will not eat until they restore my dignity.&#8221;</p>
<p>The article, published late Sunday night online, drew swift criticisms from both poles of the political spectrum.</p>
<p>On one side, the ever-pugnacious <strong><a href="http://www.mediabistro.com/Glenn-Greenwald-profile.html">Glenn Greenwald</a></strong>, the <em>Guardian</em> (and formerly Slate) columnist and an ardent human rights crusader, offered rare praise.</p>

<title>Judge Defers Ruling on Fox News Reporter</title>
<description><![CDATA[<p><strong><img class="alignright  wp-image-80213" title="Jana_Winter" src="http://www.mediabistro.com/fishbowlny/files/2013/04/Jana_Winter.png" alt="" width="225" height="216" />Judge Carlos Samour Jr.</strong> will defer his ruling on if Fox News reporter <strong><a href="http://www.mediabistro.com/Jana-Winter-profile.html">Jana Winter</a></strong> will have to testify in court about her sources. <a href="http://www.mediabistro.com/fishbowlny/fox-news-reporter-threatened-with-jail_b80186">As we noted yesterday</a>, Winter had broke a story about a notebook the Aurora, Colorado killer <strong>James Homes</strong> had sent to a psychiatrist.</p>
<p>Holmes&#8217; defense team was trying to get Winter to testify and thus reveal her sources for the book, and the judge was expected to make a decision on that matter tomorrow. Instead, Fox News <a href="http://www.foxnews.com/us/2013/04/08/colorado-judge-defers-ruling-on-whether-fox-news-reporter-must-testify-on/" target="_blank">reports</a> that Samour Jr. deferred, saying that he won&#8217;t decide on the issue until he has ruled if the notebook will be permitted as evidence.</p>
<p>Winter, to her credit, was determined to accept a jail sentence over divulging her sources. And because the notebook isn&#8217;t currently evidence, there&#8217;s a chance it could never be. This is clearly a small victory. Let&#8217;s keep our fingers crossed Winter never sees the stand.</p>

<title>Fox News Reporter Threatened with Jail</title>
<description><![CDATA[<p><strong><a href="http://www.mediabistro.com/Jana-Winter-profile.html"><img class="alignright  wp-image-80190" title="Screen Shot 2013-04-08 at 2.14.26 PM" src="http://www.mediabistro.com/fishbowlny/files/2013/04/Screen-Shot-2013-04-08-at-2.14.26-PM.png" alt="" width="188" height="204" />Jana Winter</a></strong>, a Fox News reporter, is staying silent. And for that, she could face up to six months in jail. After the Aurora, Colorado shooting, Winter broke a story that the murderer —  <strong>James Holmes</strong> — had sent a notebook to a Univesity of Colorado psychiatrist &#8220;full of details about how he was going to kill people.&#8221;</p>
<p><a href="http://www.foxnews.com/us/2013/04/05/free-press-fight-how-fox-news-reporter-wound-up-facing-jail-for-doing-job/" target="_blank">As Fox News reports</a>, because Winter isn&#8217;t revealing her sources for the notebook, she is facing time behind bars. Holmes&#8217; defense attorneys were unsuccessful in their attempts to get Colorado law enforcement agents to admit that they were Winter&#8217;s source, so now they&#8217;re going after Winter.</p>
<p>On April 10, <strong>Judge Carlos Samour Jr.</strong> will issue a decision about Winter testifying in court. Although Colorado&#8217;s &#8220;shield law&#8221; protects journalists from being incarerated for refusing to divulge sources, it does allow judges to force a reporter&#8217;s hand if prior attempts to unveil the source&#8217;s identity have failed.</p>
<p>Winter&#8217;s lawyer said that she will not divulge the source&#8217;s identity if put on the stand.</p>

<title>AP Drops &#8216;Illegal Immigrant&#8217;</title>
<description><![CDATA[<p><img class="alignright size-full wp-image-79876" title="Screen Shot 2013-04-03 at 12.59.01 PM" src="http://www.mediabistro.com/fishbowlny/files/2013/04/Screen-Shot-2013-04-03-at-12.59.01-PM.png" alt="" width="118" height="134" />Here&#8217;s something we can all stand behind: The Associated Press has decided to finally <a href="http://blog.ap.org/2013/04/02/illegal-immigrant-no-more/" target="_blank">drop &#8220;illegal immigrant&#8221; from its stylebook</a>. Rightfully so, the AP realized that using &#8220;illegal&#8221; to describe a person is wrong and carries many implications.</p>
<p>The AP&#8217;s senior vice president and executive editor, <strong><a href="http://www.mediabistro.com/Kathleen-Carroll-profile.html">Kathleen Carroll</a></strong>, said that the decision to rid the term from the AP manual came about during discussions that centered around using labels when reporting:</p>
<blockquote><p>The new section on mental health issues argues for using credibly sourced diagnoses instead of labels. Saying someone was “diagnosed with schizophrenia” instead of schizophrenic, for example. And that discussion about labeling people, instead of behavior, led us back to &#8216;illegal immigrant&#8217; again. We concluded that to be consistent, we needed to change our guidance. So we have.</p></blockquote>

<title>31 Percent of Adults Have Abandoned a News Outlet</title>
<description><![CDATA[<p><img class="alignright size-full wp-image-78930" title="newspaper_stack" src="http://www.mediabistro.com/fishbowlny/files/2013/03/newspaper_stack.jpg" alt="" width="300" height="224" />According to Pew’s new <a href="http://stateofthemedia.org/2013/overview-5/" target="_blank">State of News Media report</a>, people have begun to notice the impact of cutbacks at media outlets. As a result of the layoffs and cuts that have become a regular occurrence in the industry, almost a third of adults (31 percent) have stopped turning to a news outlet for information because they&#8217;re dissatisfied.</p>
<p>The unhappiness was boiled down to two factors: Incomplete reporting and less stories. Among those people who said they had notice financial struggles in news companies, 48 percent said that they found stories to be incomplete, and 31 percent noticed fewer stories overall.</p>
<p>Other notable findings from the Pew report:</p>
<ul>
<li>450 of the nation&#8217;s 1,380 daily newspapers are going to launch or have already implemented some sort of paywall.</li>
<li>Digital advertising grew 17 percent in 2012. It now makes up 23 percent of the total ad market. That&#8217;s up from 20 percent in 2011.</li>
<li>All major news magazines saw newsstand sales plummet last year. <em>Time</em> got it the worst, as sales dropped 27 percent compared to 2011.</li>
<li>Ad pages at news magazines also dropped. Among those studied by Pew, <em>The Week</em> was hurting the most, as ad pages declined 24.5 percent.</li>

<title>A New Pope Elected; WPIX Breaks In for Special Report</title>
<description><![CDATA[<p><img class="alignleft size-full wp-image-78579" title="WPIX pope" src="http://www.mediabistro.com/fishbowlny/files/2013/03/WPIX-pope.jpg" alt="" width="300" height="169" />The bulletin that the world has been waiting for is here! White smoke pouring from the Sistine Chapel chimney and Cardinal Bergoglio of Argentina has been named the new pope. While all the local stations in New York broke in with network coverage shortly after 2 p.m. (although WNYW was delayed in picking up Fox News Channel&#8217;s feed), it was truly a New York experience on WPIX.</p>
<p>Channel 11 did their own reporting with <strong><a href="http://www.mediabistro.com/Mary-Murphy-profile.html">Mary Murphy</a></strong> and <strong><a href="http://www.mediabistro.com/Dan-Mannarino-profile.html">Dan Mannarino</a></strong> at The Vatican. <strong><a href="http://www.mediabistro.com/Tamsen-Fadal-profile.html">Tamsen Fadal</a></strong> anchored from the PIX studios.</p>
<p>Fadal spoke on the phone with several experts and theologians.</p>
<p>There was a live glitch with one of those interviews, Maureen Tilley of Fordham University, when the call dropped and dial tone was heard. They reestablished the line a few minutes later.</p>
<p>Murphy and Mannarino also found people in the Rome crowd. The duo under umbrellas talked to a New Yorker draped in an American flag who has Cardinal Dolan on his wish list.</p>
<p>Waiting for the new pope to emerge, WPIX added a live report from <strong><a href="http://www.mediabistro.com/Ann-Mercogliano-profile.html">Ann Mercogliano</a></strong>, stationed at Dolan&#8217;s &#8220;home,&#8221; St. Patrick&#8217;s Cathedral.</p>

<title>WABC-TV Investigative Reporter Sarah Wallace Gets Big Exclusive</title>
<description><![CDATA[<p><img class="alignleft size-full wp-image-77980" title="WABC130305230744" src="http://www.mediabistro.com/fishbowlny/files/2013/03/WABC130305230744.jpg" alt="" width="300" height="169" />The word exclusive may need to be retired from TV newsrooms after WABC/Channel 7&#8242;s use last night. The words of anchor <strong><a href="http://www.mediabistro.com/Bill-Ritter-profile.html">Bill Ritter</a></strong> said it best, &#8220;New York cops can&#8217;t find him, but we did.&#8221;</p>
<p>WABC investigative reporter <strong><a href="http://www.mediabistro.com/Sarah-Wallace-profile.html">Sarah Wallace</a></strong> found Julio Acevedo, who the NYPD has been on a manhunt for since leaving the scene of a car crash that killed a young Orthodox Jewish couple in Williamsburg. The interview was coordinated through Acevedo&#8217;s former cellmate friend.</p>
<p>The story resonated further with the city. The couple was en route to the hospital early Sunday to deliver her baby. The newborn survived for one night after an emergency c-section on the dead mother.</p>
<p>Acevedo told Wallace via cell phone that &#8220;My heart goes out to all of those people. I was feeling like I&#8217;m just so much of a bad guy.&#8221;</p>
<p>Acevedo admitted to speeding because he claims to have been shot a short time earlier.</p>
<p>&#8220;That cab driver came out of nowhere. I couldn&#8217;t stop.&#8221;</p>
<p><strong><a href="http://www.mediabistro.com/Jim-Dolan-profile.html">Jim Dolan</a></strong> was the reporter to package the story last night. Given the tremendous get for Wallace we won&#8217;t come down on Dolan for wrapping up live from Williamsburg with a double negative.</p>
<p>&#8220;&#8230;Not turning himself into police is not helping his case any.&#8221;</p>

<title>NY1 Anchor Pat Kiernan Plays Panelist on CNN</title>
<description><![CDATA[<p><img class="alignleft size-full wp-image-76659" title="CNNkiernan" src="http://www.mediabistro.com/fishbowlny/files/2013/02/CNNkiernan.jpg" alt="" width="300" height="169" />CNN viewers who were waiting for the &#8220;cruise from hell&#8221; to dock in Mobile, Alabama last night were greeted by NY1 morning anchor <strong><a href="http://www.mediabistro.com/Pat-Kiernan-profile.html">Pat Kiernan</a></strong>.</p>
<p>Kiernan joined a group appearing on <em>Piers Morgan Tonight</em> with former CNBC host <strong><a href="http://www.mediabistro.com/Donny-Deutsch-profile.html">Donny Deutsch</a></strong> substituting.</p>
<p>This was not his first time on the cable news network. From 2000 to 2004, Kiernan anchored a business program on the now-defunct CNNfn. That broadcast led to assignments on the &#8220;main stage&#8221; as well.</p>
<p>In addition, Kiernan occasionally is reunited with his former CNNfn colleagues <strong><a href="http://www.mediabistro.com/Ali-Velshi-profile.html">Ali Velshi</a></strong> and <strong><a href="http://www.mediabistro.com/Christine-Romans-profile.html">Christine Romans</a></strong> on  CNN&#8217;s weekend programming.</p>

<p>But, WCBS/Channel 2 went one step further.
