Borders Files Dismissal Motion in Million Dollar Lawsuit

Borders has moved to dismiss the $1 million lawsuit filed by Jasmine-Jade Enterprises, the parent corporation of Ellora’s Cave and Cerridwen Press for allegedly “excessive” returns from the bookseller.

GalleyCat reported in January when the independent publisher sued Borders over discrepancies in book orders. In the motion for dismissal, Borders said that the book company had “short-shipped” orders, sending Borders less copies than the bookseller had originally ordered.

Dear Author reprinted part of the brief: “Throughout its commercial dealings with Borders, Plaintiff short-shipped orders. As a result, Borders was forced to warehouse the short-shipped product and, if not supplemented, to return it to Plaintiff. Plaintiff’s practice of short-shipping its orders therefore resulted in a number of returns from Borders.”
