Wired: Lawsuit Could Embarrass RIAAAccording to Wired, the fact that a file-sharing lawsuit victim filed suit against the RIAA could force the unloved record industry firm to reveal all kinds of secrets about how it goes about selecting its prey. The report said that Tanya Andersen, the single mother who filed a countersuit against the RIAA after the organization mistakenly sued her for sharing music online, attempts to hold it responsible for all sorts of heavy infractions: "RICO violations, fraud, invasion of privacy, abuse of process, electronic trespass, violation of the Computer Fraud and Abuse Act, negligent misrepresentation, the tort of 'outrage,' and deceptive business practices," among other things. But the report said that Anderson is close to bringing the case to the discovery phase, which could force the RIAA to "release potentially incriminating details about its techniques for investigating alleged file sharers." These details could include what the RIAA lawyers are paid, how the firm arrives at the average $4,000 to $5,000 settlement, how it decides to sue one person instead of another, and—here's what we really want to know—why virtually none of the settlement money ever makes it to the artists.
