NBC News "does not have to give [Scooter] Libby's defense team one page of undated notes taken by correspondent Andrea Mitchell because Walton said she is unlikely to testify at Libby's trial, which is set for January," the AP reports.

U.S. District Judge Reggie B. Walton "ruled that the subpoenas on Mitchell and NBC News either sought information as a fishing expedition or would not be relevant to Mitchell's or Russert's testimony," the Reporters Committee for Freedom of the Press says.
