Summary The Marketing Attorney will be a key member of the Legal team, responsible for providing comprehensive legal support and guidance on all marketing, advertising, and promotional activities for our consumer products. This role ensures that all consumer-facing communications, campaigns, and product claims comply with applicable laws, regulations, and industry standards, while also supporting the company's strategic marketing objectives. The Marketing Attorney will collaborate closely with Marketing, Product Development, Sales, and other cross-functional teams, serving as a trusted advisor on legal risks and opportunities related to brand promotion and consumer engagement. What You Will Do: •
Advertising & Marketing Review: o Review and approve all marketing, advertising, and promotional materials across various channels (digital, social media, print, broadcast, packaging, in-store displays) for legal compliance, including claims substantiation, truth in advertising, and unfair competition. o dvise on consumer protection laws, including FTC guidelines, state advertising laws, and industry-specific regulations. o Provide guidance on endorsements, testimonials, influencer marketing, and user-generated content. o Review sweepstakes, contests, promotions, and loyalty programs to ensure compliance with relevant laws and regulations. •
Intellectual Property: o dvise on trademark, copyright, and patent matters related to marketing campaigns, brand usage, and product development. o Support the protection and enforcement of the company's intellectual property rights in marketing contexts. •
Privacy & Data Security: o dvise on privacy laws (e.g., CCPA, GDPR, COPPA) as they relate to marketing data collection, usage, and targeted advertising. o Ensure compliance with email marketing (CAN-SPAM) and telemarketing (TCPA) regulations. •
Contract Drafting & Negotiation: o Draft, review, and negotiate a wide range of marketing-related agreements, including agency agreements, media buys, sponsorship agreements, influencer contracts, talent agreements, and promotional partnerships. •
Regulatory Compliance: o Monitor and advise on emerging legal and regulatory developments impacting marketing and advertising in the consumer products industry. o Ensure compliance with product labeling, packaging, and health/safety claims regulations. •
Training & Policy Development: o Develop and deliver training programs for marketing, sales, and product teams on advertising law, intellectual property, privacy, and compliance best practices. o Contribute to the development and implementation of internal marketing policies and guidelines. •
Risk Management & Litigation Support: o Identify and mitigate legal risks associated with marketing initiatives. o ssist in responding to consumer complaints, regulatory inquiries, and potential disputes related to marketing and advertising. •
Cross-Functional Collaboration: o Serve as a proactive legal partner to marketing, product development, R&D, and sales teams, providing practical and actionable legal advice that supports business objectives. What We Are Looking For: •
Education:
Juris Doctor (J.D.) degree from an accredited law school. •
Licensure:
Admitted to practice law and in good standing in at least one U.S. state (preferably [State where company is located]). •
Experience: o 2+ years of progressive legal experience, with a significant focus on marketing, advertising, and consumer protection law, preferably within a consumer products company or representing consumer products clients at a law firm. o Demonstrated experience advising on FTC regulations, state advertising laws, and industry self-regulatory guidelines (e.g., NAD). o Experience with intellectual property matters (trademark, copyright) in a marketing context. o Familiarity with privacy laws (e.g., CCPA, GDPR) as they relate to marketing data. •
Skills: o Strong understanding of the legal landscape governing marketing and advertising in the consumer products industry. o Excellent analytical, problem-solving, and decision-making skills. o Exceptional written and verbal communication skills, with the ability to translate complex legal concepts into clear, actionable business advice. o Proven ability to work independently and collaboratively in a fast-paced, dynamic environment. o Strong negotiation and contract drafting abilities. o High level of integrity, professionalism, and ethical conduct. o Proficiency in Microsoft Office Suite and legal research platforms.
