-The applicant has been arrested for any impaired driving offense within the two years prior to the date the agency began accepting applications. -The applicant has been arrested (with charges filed) for a crime within the last two years prior to the date the agency began accepting applications - Dishonorable discharge from the military -The applicant has unlawfully used/sold or produced any CDS within the five years prior to the date the agency began accepting applications. (This does not include marijuana or prescription drugs) -The applicant has unlawfully used or sold prescription medication within the one year prior to the date the agency began accepting applications. -The applicant has sold or produced marijuana, marijuana metabolites or THC products within one year prior to the date their application was submitted.* -The applicant has used marijuana, marijuana metabolites or THC products with or without a license within one (1) month prior to the date their application was submitted.*
* Marijuana, whether it is used medically or recreationally, remains a violation of the Federal Controlled Substances Act, 21 U.S.C. §§ 801 et seq.
