Lead the marketing law team focused on global marketing and advertising legal issues, inspiring and enabling that team to perform as a high performance team. Supervise the interface between Legal, Marketing and product development teams in the development and substantiation of advertising claims and marketing assets, including attending claims meeting and oversight of claims matrices.
Supervise and perform legal review and provide timely advice and practical guidance regarding claim substantiation strategies and the test processes and data required to support claims in all promotional and advertisement copy.Supervise and improve processes to optimize efficiency and quality control while reducing legal risk related to marketing communications worldwide.Manage the process for guiding marketers in the development of specific claim language including the development of appropriate disclaimers. Work with marketing and advertising teams and outside agencies to review and provide legal input and approval for scripts and content for television, on-line video, and other media advertising assets.Supervise team members and provide leadership related to manage the legal review of on-line and social media marketing initiatives, including BISSELL website content, bloggers, influencers, contests, sweepstakes, and PII acquisition, use and storage.Work with other team members in maintaining on-line policies, terms and conditions, and compliance statements, and ensure compliance with various regulations such as the ADA.Accountable to initiate and supervise the legal audit, review and identification of needed updates to ongoing advertising claims and campaigns.Provide leadership and substantive support to BISSELL’s global advertising and marketing claims strategy. Demonstrated subject matter expertise in all areas of advertising law and understand variances in legal standards for advertising claims within all key jurisdictions in which the Company markets products. Perform due diligence regarding Marketing and Advertising related issues regarding any prospective corporate acquisition, including an evaluation of the target’s claims substantiation discipline.Exercise mature judgment in identifying questions and issues that should be elevated to the VPGC for attention.Manage disputes and litigation associated with advertising and marketing issues, including National Advertising Division (“NAD”) challenges and Lanham Act cases and similar challenges in non-U.S. jurisdictions, coordinating with the VPGC as needed. Stay aware of legal trends associated with advertising and marketing issues, review and report on relevant NAD, FTC, and other case decisions, and assist with document retention and litigation preparedness activities relative to potential advertising/marketing disputes.Develop training materials and prepare presentations used to educate and train the Global Marketing function on legal process, compliance and risk associated with advertising claims, various marketing initiatives such as PII collection, sweepstakes, contests, and influencers, and other relevant topics.Support Commercial and Corporate Counsel in review, revision and negotiation of the Company’s primary advertising contracts. Analyze the impact of new laws and regulations related to advertising, marketing, and partner with marketing and sales managers to implement new programs and/or requirements. Assist with Company ethics and communications training and compliance as requested by the VPGC.Coordinate legal support for BISSELL’s product liability related disputes.Work closely with VPGC and other team members to ensure effective defense of full portfolio of product liability matters.Manage directly an assigned portfolio of disputes (both pre-litigation claims and product liability suits). Managing outside counsel, as appropriate, to successfully resolve product disputes. Support VPGC in providing legal advice to Company on product safety related matters, including legal requirements associated with potential product safety issues.Lead the legal coordination of any product recalls activity. Assist in recommending best-in-class processes and procedures to ensure BISSELL is appropriately managing all product safety related matters.Participate as part of BISSELL’s Legal Leadership Team in providing legal leadership to the BISSELL Law Department.
Requires a Juris Doctorate degree and 3 years of experience as a Staff Attorney (Marketing and Promotions), Marketing and Advertising Counsel or closely related occupation. Also requires 3 years’ experience evaluating advertising claims, responding to advertising disputes, advising clients regarding privacy and data-management compliance, and managing product liability matters and global product recalls.
