You Don’t Worry About That, We’re Pretty Sure You Didn’t Do It On Purpose


If you’re an architect, an engineer, a land surveyor, or some in landscaping and you find yourself explaining to the police or a jury about those “accidents” every once in awhile that you might have been responsible for, maybe it’s time you packed up and went to California. Schwarzenegger (the governor, not the one you’re thinking of, the famous physicist), has just signed a bill making it illegal to go after the person who laid out the plans to build or develop something after a “mishap”. Here’s the scoop:

Gov. Arnold Schwarzenegger on Tuesday signed AB 573, a measure that prohibits public agencies from holding design professionals responsible for defects that are not the result of the designer’s negligence or willful misconduct.

The bill, by Assemblywoman Lois Wolk (D-Davis), seeks to keep public agencies from requiring design professionals (architects, engineers, land surveyors and landscape architects) to sign provisions that would protect the agency from consequences or defects out of the designer’s control.
