Intellectual Property Conflicts Specialist
Cooley is excited to welcome an IP Conflicts Specialist to our Business Intake and Conflicts team. This role is vital for the effective management of intellectual property conflicts, ensuring that our firm's engagements are handled with both diligence and integrity.
Position Summary:
The IP Conflicts Specialist will leverage independent judgment to identify, analyze, and resolve IP conflicts requests. You will play a key role in supporting the BIC IP Supervisor by researching relevant patent information and facilitating resolutions for potential IP issues. Position Responsibilities: Analyze and process incoming conflict requests focusing on IP-related matters to ensure ethical compliance. Prepare database search terms and create detailed conflicts reports for various parties, including handling high-volume searches. Process new IP patent prosecution requests, paying attention to subject matter and technology intricacies. Conduct corporate research to verify the identities of related parties while identifying potential conflicts. Assess subject matter overlap conflicts and examine existing or potential conflicts for each request through thorough report analysis. Interpret database results and conflicts reports to assist firm partners, counsel, attorneys, and business professionals. Draft clear descriptions of the potential conflicts landscape based on professional conduct rules relevant to the legal field. Communicate effectively with partners via email and phone to discuss potential issues and recommend solutions for conflict clearances. Provide regular updates to attorneys regarding conflicts associated with new matters. Maintain comprehensive records and notes on conflict resolution for each request. Request waivers for all matters necessitating consent and ensure all conflicts are resolved efficiently. Draft conflict waivers and engagement letters as needed. Inform and guide firm attorneys regarding any special circumstances related to complex requests. Collaborate with the BIC IP Supervisor and other BIC Analysts on conflicts training for IP personnel. Engage proactively in internal training opportunities to enhance knowledge and service. Serve as the primary contact for IP Services regarding legal conflict matters. Draft and implement ethical screens to prevent conflicts. Stay informed about current legal trends and relevant information. Conduct legal ethics research to support conflict resolution efforts. Provide conflicts training for other business professionals as necessary. Complete additional duties as assigned. Skills and Experience: Required: Upon completion of orientation, demonstrate proficiency in Microsoft Office suite, iManage, and other firm applications. Availability for overtime work, including weekends when required. Proficiency in IntApp Open and Contract Express or similar software. Over 2 years of experience in conflicts and/or IP-related roles. Familiarity with the ABA Model Rules of Professional Conduct and California State Bar ethics rules. Solid understanding of corporate law practices. Experience in legal and corporate research. Preferred: Bachelor's degree or higher in chemistry, biochemistry, biology, or engineering. Experience with IP conflicts resolution. Paralegal Certificate or completion of an ethics course in a paralegal program is preferred. Prior experience as a paralegal or legal researcher in a law firm setting. Knowledge of rules under 37 C.F.R, MPEP, PCT regulations, and foreign patent prosecution guidelines. Experience in conducting research within a law firm environment.
