Responsibilities
Perform patent-related activities for products within the life sciences field, including preparing, drafting, and filing patent applications with the United States Patent and Trademark Office (USPTO), drafting and filing responses to USPTO Actions, evaluating the patentability of inventions, and construing patent claims that may be infringed upon based on the manufacture, use, or sale of the particular technology or product. Complete delegated tasks for patent attorneys on legal projects related to patent activities in the life sciences, focusing on neuroscience, and advise inventors, researchers, and attorneys on patentability and inventorship issues. Identify scientific and legal issues for legal professionals on patent litigation matters, and analyze technical documents, including academic publications, prepared patent applications, and patent claims. Prepare legal analysis of issues related to inventorship and patentability and prepare written summaries and arguments for client review. Prepare, file, and prosecute U.S. patent applications in the areas of biotechnology and pharmaceuticals and coordinate the filing and prosecution of foreign patent applications with foreign counsel. Work independently on a broad range of patent strategy matters at the direction of supervising attorneys, and utilize technical research and analysis to prosecute patents on technologies in life sciences. Prepare complete information disclosure statements and file them with the USPTO, and prepare documents required to meet docketed deadlines for review by supervising attorneys. Discuss upcoming deadlines with clients and implement client feedback on draft responses. Direct docketing staff and patent assistants regarding upcoming filings and complete docketed filings after quality review by docketing staff. Review and file USPTO forms in connection with substantive filings, and research case law and USPTO procedures relevant to prosecution of assigned cases, drafting summaries and strategic advice for supervisors and clients. Conduct telephonic interviews with patent examiners.
Requirements
Ph.D. in Neurobiology, Neuroscience, or related life science field and two years patent-related activities for products within the life sciences. Experience must include two years each of the following: preparing, filing, and prosecuting patent applications; identifying patents that could be infringed based on the manufacture, use or sale of a particular technology/product; supporting patent agents/attorneys on legal projects related to patent activities in life sciences including neurosciences; working with inventors, researchers, and attorneys to evaluate new technology, assess patentability, draft patent applications, and analyze and prepare responses to United States Patent and Trademark Office (USPTO) Actions; assisting in the preparation and prosecution of U.S. and foreign patent applications in the areas of biotechnology and pharmaceuticals; and generating and summarizing experimental results, theories, and arguments in writing. USPTO bar admission required. Experience may be gained concurrently.
Compensation
Compensation range is $150,000 - $180,000 commensurate with related experience and qualification. The salary of the candidate selected for this role will be set based on a variety of factors, including but not limited to internal equity, experience, specialty, and training. The above salary range (or hiring range) represents the firm's reasonable estimate of the range of possible compensation at the time of posting.
