Claims Litigation Attorney
An exciting opportunity to join an in‑house expanding legal team for a well‑established and successful company offering a great culture, commitment to legendary service and competitive compensation package.
We are seeking an experienced Claims Litigation Attorney. The successful candidate will have autonomy for their cases from answer to final resolution by trial, settlement, or dispositive motion. This includes analyzing cases, developing legal theories and strategies, identifying potential exposure, developing and implementing discovery plans, and preparing for court proceedings. The role also provides legal representation for the Exchange in uninsured motorist claims, underinsured motorist claims, and other legal actions based on business needs.
Flexibility for a remote, hybrid, or in‑office position, with responsibilities including both managing a caseload predominantly in western Missouri with minimal supervision and providing legal opinions, advice, and guidance to the legal team and Claims personnel.
Responsibilities
Analyze cases to determine all pertinent facts and develop legal theories and strategies in the defense of lawsuits.
Identify potential exposure to policyholders or the Exchange.
Develop and implement appropriate discovery plans and motions, as needed. This includes propounding and answering written discovery, subpoenas, review of records, taking depositions, drafting motions, retaining and conferring with experts, and obtaining witness statements.
Identify issues of liability and damages, set forth legal defenses and strategy recommendations, provide discovery plans, and if requested provide an opinion on value or any other pertinent information.
Prepare for, attend, and defend all court proceedings related to cases, including motions, trials, arbitrations, and mediations.
Communicate timely with clients and Claims regarding case developments.
Prepare and present legal opinions on claims issues.
Participate in negotiation and settlement of cases with outside parties/entities.
Provide assistance in handling other attorneys’ files as needed.
Prepare and present training programs for attorneys and Claims staff.
Other tasks as necessitated by business needs.
Requirements
JD degree from an accredited law school.
Licensed to practice law in Missouri (Kansas license a plus).
7+ years of litigation experience.
First‑chair jury trial experience.
Demonstrated ability to manage a complex workload and prioritize tasks.
Excellent written and verbal communication skills.
Ability to work independently with minimal direct day‑to‑day supervision.
