NOW HIRING: ATTORNEY WITH STRONG RESEARCH AND WRITING SKILLS

We are seeking an Attorney who excels at legal research, clear writing and interpreting complex laws. The ideal candidate can quickly analyze information, communicate findings clearly and adapt to shifting priorities.

If we are unable to fill the position at the Attorney II level, we will consider applicants at the Attorney I level to be determined by education and/or experience.

Upon a successful probationary period and all noted requirements and trainings are completed within one year, and when performing higher level duties, the supervisor can recommend a promotion from Attorney I to Attorney II at a higher rate of pay.

Job Duties

Confers with legal associates, agency staff, local government officials, and other interested parties to exchange and prepare information on the facts and status of legal and administrative actions or issues.

Research legal precedents, case reports and other legal documents to collect information for case preparation to facilitate the administration and enforcement requirements and needs of the agency.

Guides technical support and/or legal staff in the legal practices and regulations of the agency to assist in the development of a competent, professional staff.

Prepares legal documents for use by the Attorney General and/or County Attorneys offices in prosecuting civil or criminal cases.

Presents information or testimony at public meetings or judicial or legislative hearings to provide and explain legal and policy information.

Interprets provisions and advises agency staff and interested parties outside the agency regarding court decisions, administrative rules and other legal statements to respond to inquiries from them and ensure adherence and compliance by agency staff.

Drafts and analyzes proposed legislation, agency policies and procedural statements to provide agency management with legal opinions and options.

Represents the agency in administrative hearings related to the enforcement of federal and state statutes and/or administrative rules pertaining to the Agency.

Leads strategy for risk assessment, compliance and monitoring as necessary to comply with provisions of the Nebraska Emergency Management Act, the Robert T. Stafford Disaster Relief and Emergency Assistance Act, Title 2 and Title 44 of the Code of Federal Regulations and other relevant state and federal laws.

Researches and prepares drafts of Governor’s emergency proclamations, executive orders and other official documents related to emergency declarations.

Researches and prepares Memorandums of Understanding, Memorandums of Agreement, contracts between the Agency, other state agencies, other political subdivisions and federal entities.

Represents the Agency on the National Emergency Management Association Legal Liaison Committee.

Represents the Governor and Agency in field deployments as the State liaison.

Hourly pay rate range for the Attorney II is $29.395 - $43.331. Pay rate may be commensurate with education and experience if approved.

Hourly pay rate range for the Attorney I is $25.433 - $37.491. Pay rate may be commensurate with education and experience if approved.

Requirements / Qualifications
Minimum Qualifications

Attorney II: One year of experience as an attorney practicing law and providing legal services such as preparing cases, advising clients, and/or interpreting laws or administrative policies.

Attorney I: Graduation from an accredited school of law and admission to the Nebraska Bar.

Other:

Background/motor vehicle request checks will be required prior to hire. Must have a valid driver’s license. Within one year of employment successfully complete FEMA IS courses: IS-00120.c, An Introduction to Exercises; IS-00139.a, Exercise Design and Development; IS-00200.c, Basic Incident Command System for Initial Response; IS-00230.e, Fundamentals of Emergency Management; IS-00235.c, Emergency Planning; IS-00240.c, Leadership and Influence; IS-00241.c, Decision Making and Problem Solving; IS-00244.b, Developing and Managing Volunteers; IS-00700.b, An Introduction to the National Incident Management System; IS-00703.b, National Incident Management System Resource Management; IS-00800.d, National Response Framework, An Introduction; IS-01300, Introduction to Continuity of Operations; IS-02200, Basic Emergency Operations Center Functions.

Legal Requirement:

In accordance with Section 7-101, Nebraska Revised, Reissued Statutes of 1943, incumbents in this class must be admitted to the Nebraska Bar.

Knowledge of the techniques of preparing/drafting legal documents and forms; the principles and practices of criminal and civil law administration; judicial procedures and rules of evidence; the principles and practices of legal research; the procedures of trial and administrative hearings.

Skill in preparing summaries, legal analyses, findings, conclusions, briefs and other legal documents; negotiating and communicating with others sufficient to persuade their acceptance of contentious goals or viewpoints.

Ability to prepare and communicate in person and by telephone, emails, summaries and correspondence, the facts and arguments of a case to persuade others to accept the viewpoint presented; interact with legal associates, other government employees, the public, and representatives of parties involved in a case; formulate legal opinions and recommendations based on legal research and investigations; conduct legal research and investigations; prepare drafts of legal documents and forms; identify critical elements of legal questions or issues and select appropriate course of action; interpret and apply statutes, case law, decisions of judicial and administrative hearings, and administrative rules and policies.
