Mission
To lead and oversee the commercial and contractual management of projects, ensuring effective procurement, cost control, risk management, and contractual compliance, while protecting the organization’s commercial interests and supporting successful project delivery through strong leadership, governance, and collaboration.

Responsibilities

Selection, management and supervision of the project’s commercial team.

Provision of commercial and contractual advice to the project leadership team.

Development and implementation of the Procurement Management Plan and commercial and contractual management policies, procedures and systems.

Development of the Risk Management Plan, and implementation of a risk management culture across the Project aimed to an early identification and mitigation of commercial risks.

Facilitating career development for the commercial team members, including identification of training need.

Management of downstream commercial matters with subcontractors and design consultants, including but not limited to procurement, subcontracts administration, changes and claims.

Maintaining commercial costs within the approved budget.

Assisting the Project Manager to develop the quality, health & safety and environmental goals for the Project; and promoting achievement of these goals within the full project team; and,

Ensuring compliance with Federal, Provincial, and local laws, particularly applicable Occupational Health & Safety Acts/Construction Safety Act regulations and environmental requirements.

Develop and maintain a good understanding of the contractual, commercial and financial issues on the project.

Provide direction, leadership and advise on commercial strategy for successful project execution.

Prepare, maintain and facilitate access to the entire Project’s commercial documentation.

Ensure that the review on all commercial matters relating to the project is made to the highest standard of diligence

Requirements

Degree in Civil Engineering or a similar technical discipline.

A minimum of 15 years of professional experience. Minimum 5 years of experience in the heavy civil construction.

Thorough knowledge of contract language and legal requirements of contracts.

Experience working on project such as

Large-scale heavy civil infrastructure projects (highways, bridges, transit, rail, tunneling, or similar).

Public-Private Partnership (P3) projects, including Design-Build-Finance (DBF) and Design-Build-Finance-Operate-Maintain (DBFOM) models.

Design-Build project delivery, with demonstrated involvement from preconstruction through execution and close-out phases.

Projects involving complex stakeholder environments (DOTs, public agencies, concessionaires, joint ventures).

Experience managing commercial aspects of projects exceeding $100M in value (or comparable scale and complexity).

Technical Skills

Strong knowledge of contract types (lump sum, GMP, cost-plus), including advanced interpretation and administration of EPC, Design-Build, and P3 concession agreements.

Expertise in claims management, including preparation, evaluation, and negotiation of variations, change orders, and dispute resolution.

Proficiency in procurement strategies, subcontract negotiation, and supply chain management for large infrastructure projects.

Advanced cost control and forecasting, including budget development, cost reporting, earned value analysis, and financial risk assessment.

Risk management expertise, including identification, quantification, and mitigation of commercial and contractual risks.

Familiarity with construction management systems and tools (e.g., SAP, Oracle, Primavera P6, or similar ERP/project controls systems).

Strong understanding of applicable regulatory, compliance, and contractual frameworks in U.S. infrastructure projects (or relevant geography).

Ability to analyze technical project documentation (drawings, specifications) to support commercial decision-making.

Soft Skills

Strong organizational and time management skills, with the ability to manage multiple priorities under pressure.

Professional integrity and sound judgment in decision-making.

English is mandatory and Spanish language will be a plus.
