Hybrid workplace arrangement. Although this position will be designated under the department’s hybrid workplace program, it will still be required to report to the department office on a scheduled basis and at the discretion of the supervisor, based on business needs. The Division of Real Estate (DRE) protects the consumer through licensing, regulation, and enforcement of licensed real estate professionals. DRE aspires to create a balance between consumer protection and a fair and competitive business environment. DRE accomplishes this balance by providing a collaborative approach to regulation that is open, simple, and user-friendly. The Investigations work unit exists to investigate complaints filed by consumers and licensees, or opened on the boards’ own motions. The work unit ensures investigations are completed within the Division’s prescribed deadlines and that the investigations substantiate the presence or absence of a license law violation. The work unit protects consumers by identifying practitioners who are not in compliance with the practice act, reporting findings to the appropriate board or commission, and making recommendations for license discipline. Position:

SIA 7723 Responsibilities

Oversee investigations completed by a staff of investigators, including assigning caseloads, providing guidance on how to conduct an investigation, creating investigative plans, identifying potential witnesses and sources of evidence, and interviewing techniques. Edit reports, review investigations for completeness, present cases to regulatory boards for consideration, and testify in administrative, civil, and criminal proceedings. Based on findings, make recommendations to the director and/or the appropriate board regarding how to resolve complaint matters. Manage day-to-day operations of the work unit and supervise staff, including pay, status, and tenure. Duties Include

Ensuring no backlogs and monitoring the progress of the assigned investigations. Providing statistics to the Division Director. Consulting with the Office of the Attorney General regarding the veracity of the investigative findings. Providing additional evidence when necessary for cases being litigated. Serving as an expert on the applicable practice act. Referring cases to the Expedited Settlement Program and to appropriate law enforcement agencies. Responding to inquiries from the public and licensees regarding the practice act(s) and division policies and procedures. Evaluating subordinates and documenting performance in mid-year and annual reviews, in compliance with deadlines. Collaborating with other team leads to maintain consistent investigative procedures. Reviewing proposed regulations for impact on the work unit or the Division’s ability to enforce the proposed regulations. Identifying gaps in rules and proposing changes to address those problems; identifying enforcement trends and proposing regulations to address gaps in statute. Minimum Qualifications, Substitutions, Conditions Of Employment & Appeal Rights

Option 1: Experience Ten (10) years of professional real estate experience, including: Managing a heavy complaint and/or investigative caseload, including violations of administrative, civil, and/or criminal statutes; Presenting testimony at court hearings to provide data gathered during investigations; Gathering, interpreting, and analyzing evidence and facts from complex cases and applying laws. The ten (10) years must include one (1) year at the level of a work leader, staff authority, unit supervisor, or equivalent. Option 2: Combination of Education AND Experience Associate’s Degree and Experience: Degree in related field; AND eight (8) years of professional real estate experience as above. Bachelor’s Degree and Experience: Degree in related field; AND six (6) years of professional real estate experience as above. Substitutions Master’s or doctorate in a related field may substitute for a bachelor’s degree. No substitution for one year of leadership/supervisory experience. Professional experience must meet criteria described and may include partial credit for coursework toward degree requirements. Preferred Qualifications Knowledge of broker license law and related state/federal laws. Investigative experience, including gathering evidence, interviewing witnesses, and writing reports. Experience investigating or handling compliance in state government, law enforcement, or real estate. Experience assigning cases and supervising investigators. Ability to work in high-stress, high-profile environments with diverse stakeholders; foster cooperation; present investigative findings; and propose regulatory solutions. Ability to identify inconsistencies in legislation and propose changes. Required Competencies Written and verbal communication, attention to detail, sound judgment, critical thinking, problem-solving, adaptability, organizational skills, and customer service. Interpersonal, investigative, leadership, training, confidentiality, integrity, accountability, and ability to travel up to 5% as needed. Proficiency with PC software (Microsoft Office and Google Suite). Conditions of Employment
