Formed in 2023 as a 501(c)(3), the Texas Immigration Law Council (Council) is a nonpartisan statewide immigration legal resource and policy organization working to protect and promote the rights of immigrants and refugees of all nationalities in Texas. Through coalition building work, education, and legal technical support, the Council works to expand access to justice and create federal, state, and municipal immigration reforms that protect the rights of immigrants and refugees in Texas.
Project Summary:
TxILC, in collaboration with partner organizations, seeks a Habeas Attorney to support the Texas Habeas Project (THP)—a coordinated, statewide effort to expand access to federal habeas relief for individuals held in immigration detention. Habeas petitions are increasingly one of the only viable legal mechanisms to challenge prolonged or indefinite detention. To address capacity gaps, TxILC is seeking a Contract Habeas Attorney to support pro bono counsel, strengthen litigation quality, and build sustainable infrastructure.
2. Scope of Services A. Strategic Input & Project Development
Advise on case selection and legal viability of referred cases
Support project coordination among Texas Habeas Project partners
Provide recommendations to strengthen and professionalize the Texas Habeas Project’s systems, workflows, and legal support model.
B. Pro Bono Onboarding, Mentorship & Support
Support the onboarding of pro bono attorneys
Support litigation strategy development for pro bono attorneys
Mentor pro bono attorneys on litigation strategy, procedural issues, and practical considerations in Texas federal court.
Support the development of incorporating non-attorney volunteers into the project
Troubleshoot case issues as they arise, including client communication barriers and practice concerns.
C. Training & Resource Development
Develop and update pro bono attorney‑facing resource materials—practice advisories, guidance, templates, and checklists
Advise on strategies to recruit, support, and retrain pro bono attorneys willing to take habeas cases in Texas
Help identify resource gaps and help address these gaps
D. Capacity Building and Collaboration
Collaborate with TxILC staff and project partners to support nonprofit organizations engaged in habeas work
Contribute to a coordinated, sustainable model for expanding habeas capacity in Texas
Participate in meetings related to project management, legal resource development, and pro bono capacity building efforts
Identify gaps and opportunities for growth
Qualifications Required Qualifications:
Licensed in any U.S. jurisdiction
Admitted to at least one federal court in Texas
Experience litigating federal habeas cases
Preferred Qualifications:
Experience mentoring attorneys on habeas petitions
Experience developing pro bono legal resources
Contract Type: Independent contractor Term: Six Months, extension negotiable. Estimated Hours: 200+ hours. Compensation: Competitive, commensurate with experience.
