General Title Company Duties
Must be able to handle a moderate volume of residential real estate closings (25-30) from contract to closing.
Send out welcome packages to both buyer and seller.
Order title, lien search, survey, and estoppel letters.
Prepare preliminary CD and interact with buyer’s lender to ensure compliance with TRID, ensuring timeliness and immediateness.
Interact via phone and email with buyer, seller, agents, and lenders to keep all parties updated on file status, and communicate issues with title, lien search, and estoppel.
Resolve title, lien search, and estoppel issues, and complete all processing duties to keep closings timely.
Organize a closing, notifying parties of buyer requirements, obtaining wire instructions, bank approval of the closing statement, and required loan documents for funding.
Balance a closing statement and incorporate lender funding “net” or “gross,” using software such as DoubleTime or RamQuest.
Fund a transaction efficiently at the closing table to ensure all parties are satisfied.
Understand E-recording processes and the importance of timely recording and delivery to parties.
Issue title policies in a timely fashion.
General Representation Duties
Document Preparation
Draft and understand residential and commercial real estate transactions, including
Purchase and sales contracts
Due diligence timeline establishment
Preparation of critical date list
Calendar of critical dates
Preparation of Seller’s Documents (deed, bill of sale, affidavits, company resolutions)
Purchaser documents (promissory note, mortgage, closing documents)
Loan documents for financial institutions (note, mortgage, assignment of leases, closing statements)
Review of title and surveys, preparation of title commitments and policies, estoppel letters, payoffs pre and post closing matters; order all appropriate lien searches and review them.
Prepare closing statements and loan packages.
Due Diligence Activities
Complete due diligence activities and process files from contract to closing and post‑closing, understanding defined terms, preparing and monitoring contract critical dates, preparing title commitments, satisfying Schedule B‑I title conditions, reviewing Schedule B‑II title exceptions, interacting with underwriters to remove title exceptions, and working with loan closing specialists.
Law Knowledge
General knowledge of state and county customs and laws related to real estate transactions.
Understanding of residential purchase/sale contracts such as FAR and FAR/BAR.
Understanding of commercial purchase/sale contracts and leases, ability to prepare timelines.
Knowledge of title insurance regulations.
Ability to review and interpret title exceptions and B‑I title conditions, determining encumbrances.
Ability to review surveys and point out encroachments or violations.
Expertise in ordering and reviewing title in both residential and commercial transactions.
Any and all other duties as may be required of the job.
Requirements
Undergraduate degree and a minimum of three years’ experience working as a legal assistant, or a high school diploma plus formal and extensive paralegal training.
At least five years of experience working in the real estate law section of a mid‑size or large law firm.
Ability to process a volume of various types of real estate purchase and sale files and loan files simultaneously.
Multitasking abilities are required.
Strong organizational skills.
Ability to keep up‑to‑date file status reports on each file, indicating status and pending items.
Thorough knowledge of state and county customs and laws relating to real estate law, conveying property, title, surveying, condominium, and homeowner’s association laws.
Strong computer skills and ability to use Outlook calendar system and DoubleTime or RamQuest real‑estate software.
Required Licenses/Certification
High school or college degree with extensive real estate job experience.
