The laws and programs the Department administers affect every worker in the state. The Department is organized into three primary divisions which carry out the Department's principle regulatory, enforcement and promotional programs, and the administrative operations. The three primary divisions have divisions, bureaus and offices under each, which carry out the specific and specialized portions of the NCDOL mission. To learn more about the NC Department of Labor, please visit our website at .**Description of Work**The Investigator I is responsible for achieving compliance of the Wage and Hour Act, E-Verify Act, Controlled Substance Examination Regulation Act, Expunction of Records Act, Private Personnel Service Act and Job Listing Service Act by employers. Investigations are conducted either in office and or on-site at the business location. Driving both a state and or privately owned vehicle is required; therefore so is a current valid driver license. All investigations shall include audits of time and payroll records, employment policies and practices relating to payment of promised wages, jobs and hours worked for minors and other procedural compliance with E-Verify, CSERA, Expunction and PPS/JLS Acts. Investigators shall interview employers, employees or other witnesses to verify the accuracy of records, policies and other information obtained during an investigation. The investigator will make decisions as to compliance or violations; compute wages when due, negotiating for back wages due and ensuing violations are corrected. Investigators shall prepare a computer-generated report that explains the findings in each case. This report shall include supporting witness statements and other documentary evidence. If back wages or penalties are not paid; the investigator will work with a supervisor, the Legal Affairs Division and the Attorney General’s Office to litigate the case as applicable. Investigator(s) shall act as a consultant to employers, employees and other citizens to assist in the voluntary compliance with the various laws. The Investigator shall develop and maintain a thorough knowledge of state and federal wage as they pertain and hour laws and regulations, and a general knowledge of the scope and function of other agencies enforcing employment-related laws. The Investigator I shall make oral presentations to the general public when requested on applicable laws as assigned and shall perform other duties not covered that are directed orally or in writing by those within the management structure.**Knowledge Skills and Abilities/Management Preferences**## \*\*\*\*This position will close at 11:59 pm the night before the job end date\*\*\*\*## ## Wage & Hour Investigator I NC 08## Recruitment Range: $39,244.00 - $58,673.00## * ## Thorough knowledge of labor and employment laws directly affecting the Bureau’s legislative mandates particularly the Wage and Hour Act, Medical Payment Law, Controlled Substance Examination Regulation Act, Private Personnel Services Act, the Job Listing Services Act, E-Verify Act and Expunction of Criminal Records law.* ## Thorough knowledge of the Fair Labor Standards Act, related federal regulations and court opinions, and methods, procedures and practices used in the investigation of alleged violations.* ## Considerable knowledge of administrative and judicial procedures in state and federal jurisdictions.* ## Ability to plan, direct and coordinate cases using case management and time planning.* ## A high degree of accuracy and consistency is involved in this position. This requires the ability to understand and communicate all aspects of the statutes and laws enforced by the Bureau to employers and the general public.## ## The employee is responsible for rendering decisions regarding interpretation to and compliance with applicable laws mentioned. a. Complaint Investigations dealing with employees’ pay and/or the health and safety of minors must be accurate, timely and concise in order to protect the workers and the employers. b. Investigator must be up to date on the North Carolina Wage and Hour Act and Administrative Codes. These laws and codes also include the Youth Employment regulations. In addition, the Investigator must be current on the Fair Labor Standards Act (Federal Wage and Hour laws) and the Youth Employment regulations for hazardous and prohibited occupations that go with it. c. Errors in compliance, enforcement or assessment of back wages or penalties, or mishandling of a case may lead to wrongful termination of an employee, and/or substantial loss of wages or overpayment of by an employer to an employee.## ## **Minimum Education and Experience Requirements** Some state job postings say you can qualify by an “equivalent combination of education and experience.” If that language appears below, then you may qualify through EITHER years of education OR years of directly related experience, OR a combination of both.
