TV News Covers Republican Congressional Takeover (Mediaite)
During the 11 p.m. ET hour, several networks announced the big news of the night: the Republican Party will be in control of the U.S. Senate starting in January. And with the GOP projected to hold onto the House of Representatives, this will set up a new dynamic of power in Washington: a Republican-dominated Congress versus the Democratic president. TVNewser The coverage produced several interesting moments; take CNN’s call on control of the House of Representatives. CNN’s Anderson Cooper threw to Wolf Blitzer with a promise of a “big projection.” Blitzer said it was, bigger than big, a “major, major projection” in the fight for control of the House. “Which party is coming out ahead? Get ready for that major projection right now.” And CNN rolled the full screen “CNN Projection” graphic, after which Blitzer himself poured ice water all over the preceding 30 seconds of dramatic hype: “Not a major surprise by any means.” TVNewser John Heilemann and Mark Halperin, hosting their first election night for BloombergTV, were discussing the West Virginia Senate race when Halperin said, “Two news organizations, both CNN and Fox News, are predicting that Shelley Moore Capito will be the winner.” A few minutes after that, Bloomberg cited CNN once again, which had called the Ohio governor race for John Kasich. Politico / Dylan Byers on Media Fox News broadcast exit polls from the New Hampshire Senate race almost two hours before polls closed in that state, a move that is likely in violation of agreed-upon rules by the media companies that commission the exit polls. TVNewser Earlier Tuesday, Jon Stewart stopped by CNN for an interview with Christiane Amanpour. Stewart told Amanpour he didn’t vote because, having just moved out of New York State, he didn’t know where his polling place is. TVNewser On his live show Tuesday night, he took a moment to apologize, saying it should have been more clear that he was just kidding, and he did, in fact, vote. Mediaite Stephen Colbert decided to show up CNN, Fox News and MSNBC with some over-the-top midterm coverage of his own. Only his involved the dark arts, a giant cauldron and Colbert selling his soul to the devil himself. TVNewser Legendary NBC News anchor Tom Brokaw was making an appearance on MSNBC’s election coverage when suddenly it sounded like a fire alarm might be going off in the studio. Brokaw then surprised Rachel Maddow and pulled out a giant smartphone with the alarm ringing on full blast.

The View is moving from the entertainment unit of ABC to the non-fiction programming group of ABC News. THR New ABC News head James Goldston, who will now oversee The View, announced the move in a staff memo sent out on Thursday morning. Goldston is largely responsible for Good Morning America’s transformation to a multi-anchor ensemble, which helped the ABC morning show end NBC rival Today’s 16-year morning-news ratings winning streak. He’s also responsible for remaking Nightline into a multi-anchor, multi-topic program in the wake of Ted Koppel’s retirement. HuffPost / AP Following the retirement of Barbara Walters from an on-air role at the show she started, ABC brought in Rosie O’Donnell, Nicolle Wallace and Rosie Perez to join holdover Whoopi Goldberg. A new production team was named, led by Bill Wolff, Rachel Maddow’s former producer. Capital New York Still, after a strong first week, the program has begun to slip in the ratings. For the week of Oct. 12, CBS’ The Talk, which is clearly based on the format of The View, matched the program in two key demos: women 25-54 and women 18-49. Variety One of Goldston’s central goals, according to insiders, is to make The View more appealing to younger viewers. The show has fallen 10 percent in the last year among female viewers between the ages of 18 to 49, but it’s up 1 percent in total viewers.

David Gregory to Join Katie Couric for Election Special on Yahoo! (NYT)
David Gregory, who was replaced as host of NBC’s Meet The Press in August, will appear in a Yahoo! midterm election program with Katie Couric, the company said Tuesday. TVNewser Gregory is not joining the company, but these appearances often can lead to more permanent placements. Matt Bai, who left The New York Times for Yahoo! last year, and Politico’s Mike Allen are also a part of Yahoo!’s coverage. TVNewser Mark Halperin and John Heilemann will lead Bloomberg’s election night coverage, dubbed Election All-Nighter, which begins at 5 p.m. ET with a special edition of With All Due Respect. Primetime coverage starts at 7 p.m. ET, with Halperin and Heileman joined by Al Hunt and analysts Kim Alfano, Bill Burton, Lanhee Chen, Fred Davis, Patti Solis Doyle, Anita Dunn, Michael Feldman and John Sununu. Jay Leno Nears Deal to Launch CNBC Show (THR / The Live Feed)
Jay Leno is lining up his first regular television hosting gig since leaving The Tonight Show in February, and he’s staying in the NBCUniversal family. TVNewser Leno’s new show would air on CNBC in primetime and focus on his longtime love of cars. WSJ / CMO Today A CNBC spokesperson declined to comment. Both NBC and CNBC are units of Comcast Corp. Since he stepped down from The Tonight Show, he has continued to work as a stand-up comic. He is known for his love of automobiles and has a large collection of rare and classic cars. NYT No other details have been released pending completion of the contract, though the executives confirmed the show would not be comedy-based. Leno has been a regular presence on NBC.com with a motor-vehicle-obsessed show called Jay Leno’s Garage. Deadline Hollywood The news comes as the cable business network comes off its lowest-rated quarter of the year in primetime and the lowest-rated quarter in its history in the demo for the business day, 9 a.m.-5 p.m. CNBC has been looking to broaden its primetime slate with reality TV formats. To date, its most successful such bid has been its reruns of ABC’s Mark Burnett-produced Shark Tank.

Big changes have just hit Condé Nast. Editorial director Tom Wallace and COO and CFO John Bellando are both leaving the company, while David Geithner — a former veteran of Time Inc. — is joining as CFO. Capital New York Wallace, who had previously served as editor-in-chief of Condé Nast Traveler, had been editorial director since 2005, helping to craft a consistent brand across the company’s many glossies and its many special editions. WWD / Memo Pad Several other major management changes were revealed, including the expansion of responsibilities of Robert A. Sauerberg Jr., president of Condé Nast. According to a memo, Sauerberg “will assume a leading role in all revenue generation activities, including taking direct responsibility for the Condé Nast Media Group, as well as brand revenue growth.” This will expand his areas of responsibility beyond the management of digital, technology, consumer marketing, business development, corporate administration and Condé Nast Entertainment. THR Bellando joined the company’s executive ranks in 1999. Geithner had spent more than two decades at Time Inc. prior to the appointment at Condé Nast. Most recently, Geithner served as the EVP and president of Time Inc.’s Entertainment Group, and exited the company earlier this year as part of the reorganization prior to the spinoff of the publisher from Time Warner. Time Inc. chairman and CEO Joe Ripp announced Geithner’s departure in a memo on Feb. 4, singling out his contributions to People, Entertainment Weekly and InStyle. WSJ The changes come as Condé Nast, a unit of Advance Publications Inc., is pushing to capture more digital related advertising dollars. Earlier this month, Condé Nast launched a new online video hub called The Scene, intended to serve as a home for all its video channels, including original programming such as The Single Life and Strictly Ballet.

According to preliminary Nielsen data, Diane Sawyer’s interview with Hillary Clinton averaged 6.079 million viewers in the 9 p.m. ET hour Monday night. Sawyer had the first interview with Clinton as the former Secretary of State began her press tour for Hard Choices, out Tuesday. FishbowlDC ABC led CBS and NBC in viewers for the hour. On top in ratings Monday night was Fox, which aired 24 and averaged 6.333 million viewers in the 9 to 10 p.m. hour. Deadline Hollywood However, the interview drew a 1.0 in the demo, finishing last in the 9 p.m. hour among the Big 4 networks. CNN Clinton also appeared on ABC’s Good Morning America Tuesday to promote her book. Hard Choices is about Clinton’s years as President Barack Obama’s first secretary of state, which she stepped away from early last year. In her ABC appearances, she honed what is likely to be her book tour message — one of a thoughtful diplomat who is prepared to reintroduce herself to voters, especially women. With her book lining the walls of booksellers nationwide, Clinton also stopped at a Barnes & Noble in Manhattan Tuesday for her first book signing of the two-week tour. NBC News While Clinton has been traveling the country doing paid speeches in recent months, this book tour will put her on a much more rigorous — and campaign-like — schedule. She will visit at least 15 different cities over the next two weeks, including Washington, Philadelphia, Seattle, Los Angeles, Kansas City and Austin. ABC News Asking Center for Public Integrity to Share Pulitzer Prize (TVNewser)
ABC News is calling on the Center for Public Integrity to share its Pulitzer Prize for investigative journalism, awarded to CPI’s Chris Hamby, taking issue with CPI’s Pulitzer submission that depicts ABC News as a minor partner in a year-long coal-mining industry investigation instead of equal partners. HuffPost Network president Ben Sherwood sent a four-page letter to CPI’s executive director Bill Buzenberg affirming that ABC News was CPI’s partner in the investigation. He argued that reporters Brian Ross and Matthew Mosk made “significant contributions” without which CPI would not have won the Pulitzer. He added that while the prizes are only awarded to print organizations, he hoped the Pulitzer committee would recognize Ross and Mosk. Mediaite In the letter, Sherwood said Buzenberg “omitted the names of ABC News reporters and sought to parse and diminish their contributions, even though their bylines appropriately appear on four of the eight articles submitted by the Center to the committee.” Poynter In response, Buzenberg provided a point-by-point rebuttal saying CPI reporter Chris Hamby was the engine behind the story for months before ABC entered the investigation and in long stretches when ABC was working on other things. Politico / Dylan Byers on Media CPI and ABC News have shared recognition for the black lung benefits story in the past. In March, the Harvard Goldsmith Prize for Investigative Reporting was awarded to Chris Hamby, Ronnie Greene, Jim Morris and Chris Zubak-Skees of CPI and Matthew Mosk, Brian Ross and Rhonda Schwartz of ABC News. Next month, the White House Correspondents’ Association will honor “The Center for Public Integrity, in partnership with ABC News.” On Wednesday, they received an award from the Society of Professional Journalists. Television news organizations are excluded from the Pulitzer Prizes, which honor newspaper and digital reporting.

[Goodfellas co-owner Marc] Cosentino, a retired NYPD sergeant, got an evidence bag from one of his NYPD friends and put the silverware on display behind the bar. Some people have even stopped into the pizza joint just to take pictures of it, Cosentino said.

Why haven’t other media outlets picked up on the incredible October 22 Bloomberg Businessweek story about some shady, profitable Wall Street maneuvers involving NYC equity firm Blackstone and Spanish gambling outfit Codere? That’s what Jon Stewart and Samantha Bee wanted to know last night on The Daily Show.

And so, Michael Moore/Roger and Me-style, Bee marched over first to the New York Times, where she spoke with reporter Gretchen Morgenson. Together, they engaged in a hilarious ten-second test. Ultimately though, the story fell victim to being “just another day on Wall Street.”

Google Wins 8-Year Book-Scanning Battle (GalleyCat)
Google has won its controversial book scanning fight with the Author’s Guild. U.S. Circuit Judge Denny Chin ruled in favor of Google on Thursday claiming that Google’s massive book scanning project, in which the online giant scanned millions of books and made them available through search without obtaining the permission of the copyright holders, to be legal. According to Chin’s ruling, Google’s project makes life easier for research, makes it easier for libraries to obtain digital copies of books, brings old books to light and gives people who would not have access to books access. GigaOM Chin also rejected the theory that Google was depriving authors of income, noting that the company does not sell the scans or make whole copies of books available. He concluded, instead, that Google Books served to help readers discover new books and amounted to “new income from authors.” Reuters “This is a big win for Google, and it blesses other search results that Google displays, such as news or images,” said James Grimmelmann, a University of Maryland intellectual property law professor who has followed the case. “It is also a good ruling for libraries and researchers, because the opinion recognizes the public benefit of making books available,” he added. Wired / Threat Level If the ruling had gone the other way, Google would have faced the Copyright Act’s hefty damages of up to $150,000 per infringement. NYT Google began its book-scanning project in 2004, without obtaining permission from copyright holders. The next year, groups representing authors and publishers sued Google claiming copyright violations, beginning an eight-year court battle. The Author’s Guild “We disagree with and are disappointed by the court’s decision,” Authors Guild executive director Paul Aiken said. “This case presents a fundamental challenge to copyright that merits review by a higher court. Google made unauthorized digital editions of nearly all of the world’s valuable copyright-protected literature and profits from displaying those works. In our view, such mass digitization and exploitation far exceeds the bounds of fair use defense. We plan to appeal the decision.”
