BREAKING: The Supreme Court declines to hear Matt & Judy appeal

The Supreme Court won’t hear the appeal of Matthew Cooper and Judith Miller, who have been held in contempt for refusing to disclose who leaked Valerie Plame’s identity.

This means two things: one, the Supreme Court will not be revisiting the issue of journalistic privilege and anonymous sources. Which means that, in short, there is none. Two, it means that Matt Cooper and Judith Miller could well be going to jail.

It falls to the original presiding U.S. District Court justice, Judge Hogan, to rule on jail time. According to Floyd Abrams, quoted in E&P, “it would be a matter of days or weeks.”
