For Rather: Newseum Tonight, Court Tomorrow

First on TVNewser: Dan Rather's lawyers have served CBS with an amended complaint related to Rather's fraud case against his former employer. The complaint will be filed with the court tomorrow morning. TVNewser has learned the amended complaint contains details about Rather's last days at CBS including, we hear, particulars about that flawed National Guard Story.

In a statement, Rather says "In essence, the Amended Complaint provides specific detail in support of the fraud claim. I continue to stay focused on the big picture and look forward to getting to the truth."

Rather is anchoring a primary special on HDNet tonight, live from the Newseum in Washington, DC.

CBS: Judge "Seriously" Considers Motion To Dismiss Rather Suit

Dan Rather's case against Viacom and his former bosses at CBS went to court today. CBS released the following statement to TVNewser about the proceedings:

We are very pleased that the judge is seriously considering our motion to dismiss the case, and we eagerly await his decision on that motion. In that regard, the court indicated that portions of the lawsuit may not survive our motion to dismiss. In the meantime, the court has said that discovery can begin subject to agreement on its scope by the parties, which is standard procedure in this Court. We look forward to discussing with Mr. Rather's representatives what that scope might be.

Lane Arrested, Shep Talks Up Tabs

ShepLane_1217.jpgOkay, we've been looking for a way to do this story all day. And Shep Smith gave us a hook. It's the story of Philadelphia anchorwoman Alycia Lane, who was arrested early Sunday morning in New York City for allegedly hitting a police officer and calling her a "dyke." Here's the criminal complaint from Philly.com.

As Trace Gallagher wrapped up a report on the arrest during Studio B, Shepard Smith talked about how the story was splashed on the front pages of the tabloids, including the News Corp-owned New York Post. "There is a whole spread on this, if you enjoy this kind of news this is the right city for it," Smith said.

Lane_1217.JPGAs for Lane, her lawyer tells the NYDaily News Lane "never hit or ever said any derogatory comments to anyone." She is on vacation from her main co-anchor gig at KYW-TV. Here is how CBS3 is reporting the story.

MSNBC Takes On FNC Over Regan Lawsuit

Shuster_Regan_1114.jpgMSNBC is taking a swipe at FNC over the $100M lawsuit filed by Judith Regan. Regan worked for News Corp.-owned publisher HarperCollins. This is how MSNBC's David Shuster, who once worked for FNC, reported the story in the 9amET hour:

"This is bad news, perhaps not just for Rudy Giuliani, but also for Fox News Channel. Roger Ailes who is in charge of Fox News, a close friend of Rupert Murdoch, he's been close friends with Rudy Giuliani for 20 years. Fox News commentator Sean Hannity led a Giuliani fund-raiser."

"Here you have a $100 million lawsuit in which Judith Regan is alleging that there was a smear campaign against her to protect the political agenda of Fox News of News Corp. and that that political agenda was to protect Rudy Giuliani"

Nets Cover Simpson Hearing

CourtTV_1109.JPGBecause I was busy learning about RSS feeds, internet law and blogging for dollars at the Blog World Expo in Las Vegas, I nearly forgot about day one of the O.J. Simpson hearing. So I stopped at the courthouse this morning as network correspondents lined up to cover day two.

FNC's Adam Housley, NBC's Michael Okwu, CNN's Dan Simon and CBS' Manuel Gallegus are among the network correspondents covering the hearing. CourtTV (soon to be truTV) has a make-shift set to cover the proceedings.

Housley1_1109.JPGThe correspondents are lined up along a half-block stretch of a closed-down Clark Ave. The live shot location is just steps from where Simpson, the witnesses, and lawyers enter and exit the courthouse.

The buzz outside the courthouse this morning came mostly from producers staying in contact with assignment desks and control rooms in New York and Atlanta. The circus atmosphere that accompanied Simpson's first appearance has mostly subsided with only a few characters milling around this morning.

Rita Cosby's Literary Ambition

"Does Dan Really Think He Can Win This Suit?"

If you haven't had your fill of "Dan" news, then here's one more: former WCBS reporter James Brady, now writing for Forbes.

"Does Dan really think he can win this suit? Or is he just hoping for a big cash settlement on grounds CBS doesn't need more bad press? Was he canned to "pacify the White House?" Hate to believe that. Not the way I feel about CBS and its traditions even now, 20 years after I left.

But wouldn't it be fun (if you're a news junkie or a Democrat) if Dan actually dug up some facts the whole network couldn't find three years ago. I don't know where the truth lies but I know what isn't fun: seeing old colleagues snarling and hiring lawyers."

Dan Rather: "Respect For the Presidency"

Rather.jpgAt the weekly "Q&A Cafe" at Nathans restaurant Wednesday, Dan Rather was interviewed by forum host Carol Joynt. As FBDC's Patrick Gavin reports in the Washington Examiner, Joynt asks Rather whether "he'd like to" have President Bush called as a witness should Rather's CBS lawsuit go to trial. "I'd like not to answer the question," Rather said.

Joynt also asks "if (Rather) believes the President hates him, and Rather responded by saying that 'hate is a strong word.' Then, he began to well up. 'You've never met anybody who had more respect for the presidency than I do,' said Rather, choking back tears."

Rather's Suit: The Write Ups

Rather_920.jpgTVWeek's Michele Greppi: "Mr. Rather's attorney, Marty Gold, said in a statement, 'A healthy democracy cannot flourish without an independent press. Dan Rather brings this lawsuit to further that principle and to restore his reputation, and if he is successful, he intends to donate substantial sums to further these ideals."

B&C's Marisa Guthrie: "CBS' 'only obligation is to pay him,' says an industry insider well versed in contractual law. 'They are not obligated to keep him on the air. If he thought they were wrong, he should not have taken their money; he should have walked out the door and immediately sued them.'"

NYDaily News' Jose Martinez: "'We did not go in this on blind faith, but on the preponderance of evidence,' Rather told the Daily News after the [National Guard] story aired. 'We checked our source out, but we didn't check him out enough.'"
